Protection of young persons act into force

We reported already on the reform of youth protection in Germany. The new provisions of the Protection of Young Persons Act come into force on 04.01.2016.

With the change in legislation the delivery and consumption bans of tobacco to children and adolescents on electronic cigarettes and electronic shishas (water pipes) may be extended. They may also be delivered through mail only to adults.

However, the majority of the distributors of e-cigarettes sold always -without the statutory compulsory e-cigarettes only to adults.

The amendments to the Youth Protection Act are now in the Federal Law Gazette promulgated and thus occur on 4.1.2016 into force.

The explanatory memorandum gives clues for traders, as the new law is implemented. Nevertheless, many questions remain unanswered. In particular it is questionable how the double (age) is technically implement authentication. Lawmakers have missed it, to formulate clear rules.
